How many final warnings can I get...

I received a final written warning about 2.5 months back (just before xmas).

today, i received my second. I did mention to them I had one already and asked why is he giving me another. The guy seemed a bit clueless, bless him.

The first one was fair enough but the second one was due to a customer complaint. said I was rude to her. She swore at me so I ignored her and walked off. Had a witness too (customer) but they weren't interested in it (shocker).

Don't get me wrong, i don't want the boot but I'm not exactly dying to stay with the company after recent events.

anyway... I thought a final warning was meant to be just that... why would I have gotten a second if they are meant to last 52 weeks?

Final written warnings do last 52 weeks but you should have recieved two other written warnings beforehand?

Not necessarily - you can get a final written warning straight off if its serious enough.

First one was enough I think.

Second one was just a complaint that I was rude. Seems excessive in my opinion.  Not like I swore at the customer.

Nothing to say they have to escalate where they are in the disciplinary system each time. The final warning in this case just restarts the clock.

By giving you another final warning, it restarts the 52 week clock. Also, if you were dismissed down the road and took them to tribunal, they could argue they’ve shown you support, instead of doing 1 warning - dismissal.

If you believe your actions were justified appeal - that's what the appeal process is for.

You can get as many as you like if they are not acted upon, but in a competently run store, one I would imagine.

Could be a final warning for attendence and separate for conduct. Also they could have reissued as a customer complaint may have warrented a warning but they idnt feel it warrented you being dismissed. Hence 2nd final.

The warnings have to be for the same thing for it to escalate, So get one for ignoring health and safety then get another for being rude to a customer is the right thing they would not be able to escalate the H&S one to sack you.

forever mate, they are supposed to be live for an amount of time but they will be wheeled out every time you go in for a meeting.

I was told Finals are live for a year. However, they will never disappear from record and the SM will cast everything up if he/she is thinking of dismissing you if they want. I know those who have had 6 within a year for different issues. I also know someone who had 2 over 10 years for the same thing and he got the boot. Have also seen SM brush things under the carpet. Have seen a few cases of drugs and alcohol misuse issues over the year some SMs will hang that persons out to dry and others will just try to put a support plan in place. In some stores you'd be dismissing somone every other week based on evidence or rational and the culture isn't great as it is. Tesco inconsistant approach leaves them wide open to unfair dismissal claims. You wont always lose your job if caught doing an act of gross misconduct, I know  :) >:D. You might even win on appeal. There is no point in dismissing those who are daft and forgot they had been caught before who are no threat to others or the business, maybe come to an unwritten agreement to dock wages/work time back for example.

Surely any gross misconduct if proven means one is a threat to either the company or others, I mean gross misconduct is stuff like theft, bullying, physical and or sexual attacks, fraud etc etc.

You would think so.  But we have seen many more minor transgressions being treated as gross misconduct.

Times have changed. It used to be "retain and retrain" but those days have gone.

I don’t see people queueing up to work at Tesco being almost the lowest paid supermarket now. Well not anyone half decent. It’s on many occasion just a stop gap job or for those who have failed at Aldi/Lidl.  As for changed days I don’t see people being dismissed every week at large stores where there are people committing gross misconduct every other day. You wouldn’t get other companies letting staff wear what they want and pick what they do is just a few examples. Tesco issue is there is too many resistant to change and directors underestimated the impact discounters would have.  Maybe they were just clever thieves who never really gave a toss. No better than a lot of your managers on the shop floor.

Sorry to High jack thread but I can't post as not donated.
I'm having an investigation done on me for a customer saying I told her I wouldn't look for product and go find someone else.  I've never had a complaint before and worked for company for 12 years too a high standard, good pick rate and very low complaints on my shops for customers so they can see I'm conscientious.

I didn't say what customer had said I did, don't even recall having any sort of negative interactions with a customer on day it was supposed to have happened.
 
I had investigation meeting on Friday but it got adjourned as my manager wanted to speak again to the colleague the customer made complaint to to get her side of story.  She wasn't a witness by the way just the person customer apparently approached after myself.  Where do I stand with this?

I'm 4 months pregnant and ended up going home Friday after meeting got paused as I started having a panic attack.  My midwife says I need to go off sick as its physically affecting me with the stress of a potential disciplinary.
I'm just so frightened as it's really scared me this out right lie on part of customer.  Saying I'm abrupt, I could reflect on and look at myself and check how I speak if that makes sense.  But 2 out right lies saying I verbally said no joy helping you and go find someone else.

I don't know what to do

Your health comes first and foremost...take your midwives advice.

With regard customer complaints, this is where Tesco have gone too far with customer focus. There should be no investigation, it should just be your manager having a let's talk with you, informing you that a complaint has been made and getting your feedback. Your manager should know you and be able to make a decision based on working with you and your past work standards.

Prepare a written statement, and give it to your rep and request they produce it in your next meeting, to go into the records. Also ask your rep to speak on your behalf, due to your concern of undue stress having a negative impact on your current medical circumstances. You will be present at the meeting, but you will not be expected to speak or answer questions, as you have requested your rep pose and answer all questions on your behalf.
