Anyone know how to work out banked holiday entitlement owed from a 1998 contract?

Sherwoodforest

Holiday entitlement is all in hours now ,it tells you on your wage slip the hours.plus personal day

Raise a ticket on colleague help and they will tell you what your entitlement is.....however I have no idea how you check what they provide is correct.

Sherwoodforest

Sure on our tesco theres a formula for working it out

I've just left the company so can't get access to any policies.  It's for holidays owed from starting the company in 1998,  for the first number of months employment holidays were banked rather than being allowed to take then.  Banked holidays were then to be paid when you left the company or retired.  Just wondering if anyone knows what calculation is used to work out how much holiday money is owed.

lucgeo

Accrued leave should have been calculated and paid before you left!

It would be based on the contracted hours you were working at that time of joining, and the hourly rate you were receiving at the time of leaving!

I assumed that too but they didn't pay me anything.   After being back and forward a few times with wages they have agreed that I am right and am now owed the money. Just wondering how it is worked out to ensure that's its correct.

lucgeo

Oh that old chestnut... 8-) quite a few times with colleagues leaving, retiring or being made redundant, that asked me for advise or support, would not have been told about the accrued holiday payment, the same rehearsed surprised look from wages when I asked for a print out, you'd think it was coming out of their own pocket!
Some Colleagues didn't know about the 6 month retirement plan in dropping a 5th of your contracted hours on full pay either  ???

Yes that old chestnut lol... just want to make sure I'm paid correctly and get this sorted out once and for all

Morris999

You should be paid the outstanding holidays at current pay rate.
I'll be honest not had someone leave on that contract since work & pay was introduced so know idea how it's worked out in your pay.
I'll be surprised if they even realised that when they introduced it, as the people who did it most likely didn't work for the company back then and even know about the old contracts!

lucgeo

Especially worth bearing in mind, is most people joined the company on full time or higher hour contracts, and may have dropped hours/shifts over the years.

So final holiday pay must be calculated on your starting contracted hours, not your leaving contracted hours.

Accrued holidays are based on your current hours. I started in the 1980s and will be paid out 6 x 30 hours contracted when I leave. I am a wages clerk and can see that information on W&P.r

Mumsie14, this is the relevant information for you.
c) Banking scheme
• All colleagues employed in stores between 6th October 1996 and 11th January 2003 (except for StoreManagers)
These colleagues were not able to take any holiday in the first three months of employment and the holiday they earned (one week) was banked and will be paid to them
when they leave Tesco at their current daily rate of pay.

lucgeo

I'm thinking that can't be right! Unless the policy has drastically changed and been agreed by the union ???
It should be based on the hours you were contracted to when you joined the company, when their holiday entitlement was frozen! Therefore those on 36.5 hour contracts, common in the 80's and 90's, was banked and resulted in a weeks/36.5 holiday entitlement owed!

Lots of colleagues have dropped hours and shifts over the years, therefore to pay their accrued holiday pay at their current hours, if less than their starting contract, then basically they're being robbed :o

Also on the flip side, those who joined on low hour contracts which were banked, who have now increased their hourly contracts over the years are to be paid in excess in what they worked back then  ???

Did you have a 30 hour contract in the 80's when you joined the company ???

That should be current hourly rate on their banked weeks/ hourly pay 8-) don't give a monkeys what Tesco have dreamed up!! I would challenge that forcefully as they are deliberately withholding payments due!!  >:(

yes 36 days if 15+ years. 34 days if 10-15 years. don't know how many if 20 or 25 years. basically 7 weeks plus 8 bank holidays for 15+ or 6 weeks and 2 days plus 8 bank holidays for 10-15 years. you also get a personal day on top

Reindeerparty

Thanks for your reply sherwood Forest I have over 22years service.

NightAndDay

Holidays would be calculated like in the majority of places as pro-rata this can be calculated and applied dynamically even if your contracted hours changed part way through the year.

I work 4 nights a week 30 hours in total have 34yrs service  .holiday entitlement approx 24.5 days 6 Bank hols and  personal day  so it would roughly be that but probably  you would be entitled a few more hols up til April as previously been full time .

why is this wrong??

5fdp

Hi . Your remaining holiday hours will depend on how many hours you have already taken off. If you have used more than you have reached at the time of changing hours it will reduce. The system automatically works out your remaining hours so it will be on your payslip. Your mgr can also show you on the screen. It all depends if you have taken too many holidays at 5 nights before you went down to 4 nights. You can't get screwed as it will sit as outstanding hols on the bosses system.

Reindeerparty

Hi 5fdp

I still have 5 days more hol to take + the 5 b/hol hrs. I am starting my 4 nights as from this week. Thanks to everyone  who replied to my post :)
