Only way I can see them giving less is by counting it as a formal flexible working request? but even then if there are hours available to be filled on a job role you should be prioritised for increasing back up

if it is though:

"12. Can I change my mind after submitting a flexible working request?

"If you have already started your new working arrangement and you wish to revert to your previous arrangement, the opportunity to do this will be reviewed on a case-by-case basis by your manager to see if your request can be agreed."

so worth raising it as an issue, it does seem a fit fishy the way its been done to be honest as normally it'd be discussed prior to it all happening and an agreement?

You can't advertise a role for less than 16hrs now and we have been told not to reduce anyone's hours to less than 12 under new rules.

So I'd question how the role you have been offered ie even allowed to be created.

When you changed job role, who agreed to it and was there any mention of your contracted hours? e.g, "while we can accommodate change of departments, we are unable to offer you your current contracted hours"

Were you aware that the new role was only for 10 hours?

Did you request the change or did they suggest it, as this makes a difference.

Understandably you don't state the incident, but was this something Tesco should have protected you from under their obligations for duty of care.

The rule of thumb is...if YOU request to move department, then they will try to accommodate you, but they are not obliged to give the same hours of contract, so if you knew the other role was a 10 hour contract and requested it, then that's the hours on offer for you to take or decline.

If YOU request to move departments, and you are on a higher skilled rate, but the new department is a lower band, then you drop to the lower band rate.

But if THEY ask you to move to a department, but that role is either less hours contract, lower pay band rate or both, then they MUST accommodate your contract...find you the extra hours and you keep the higher rate of pay.

@lucgeo as far as i can see it is selective discrimination, employee selected by the complainant and then followed up by the store and ignoring employees points about the attendance status of the van and the unclear definition of same in employers handbooks and/or training, now after horse has bolted employer is trying to 'clarify' a little too late. The notice in dept in my view is an admission that it goes on pretty much as the norm

Dot Com / Changed my contracted hours
Last post by BB41 - 26-04-24, 09:04AM
Good Morning and thank you for having me , I work in Dot.com started as a delivery driver but due to an incident working a late shift I requested a change to click and collect as a pod driver  evenings and all day  Sunday

My contracted hours are 17 hours but have been informed today that as ``I only work evenings they can only offer 10 with other time made up with over time if available.

I've always helped out whenever covering other shifts at short notice so feel pretty upset about this.

Can they do this? . I only started in December so don't want to leave as I do enjoy it

So the guy is being singled out and disciplined for a common practice that is commonplace amongst your and other stores? This  could be interpreted as..

"selective discrimination"

When, if ever, was the last training signed off by the colleague that covered and fully explained the policies and rules on "idling"?

When was the last updated version printed, and has training been given after this latest printed version?

Why is there a notice now displayed in the department regarding "idling", if it isn't an accepted normal daily routine practised by most?

Both the notice and the handbook are extremely vague regarding "idling" with imprecise wording of the rules.

These are some of the points and questions I'd be raising, ever so courteously  ;)

yeah its definitely worth challenging, if i can find information on the site im always happy to look, i like rooting for information  :D

Hopefully an overturn with an appeal and possibly go for the targeted stage would be my plan, since they are happy for others within reason but 1 gets punished no matter what.
