Punished twice for speeding, advice needed.

Hi guys.
I need some advice from you guys please.

One of our drivers got flagged for speeding, he got a Let's Talk. But now he has a investigation/disciplinary for the same incident, can they do that??

He has 5 instances of speeding in 6 years, is there a policy on number of instances needed to trigger a warning??

The one in question, he was coming out of a built up area into country roads,so it's a grey area if he was even speeding.

If it's according to software that has a reputation for being unreliable or it is because of how the technology works then it can't be used as evidence in a investigation/disciplinary, the standards of proof required are lower than in a court but it has to still be solid evidence.

In short, if they get rid of him solely based on software that is questionable, an employment tribunal judge would rule in favour for unfair dismissal.

It's been stated elsewhere on here that Lightfoot should be calibrated when installed in a van, but this hasn't been done at Tesco (as evidenced by the wildly different way in which the Nag Box responds from one van to another). If the system isn't calibrated, then any evidence produced by it is surely worthless.

A let's talk is not a punishment. It could be that it was given as per process and then when filed, the history was reviewed and that triggered the investigation.

A long time ago when I did dotcom , if there had been an incident eg; accident , spending,  van damage etc a driver could not drive until they'd been asked about it  . The let's talk just could have been a box ticking exercise so driver could take their run out.  Although this policy could have changed .

Does anyone know if this is still the case, we have a guy at our store that was'nt informed of a alleged speeding offense until 3 days after, he drove all of those days.
