Lets face it any company that can get over 25% of a horse in a small burger could get a little bird in a packet of salad  :)

There is absolutely no excuse for this level of infestation. A good company would have robust systems to deal with rodents. Tesco have once again show that they only ever want to do things on the cheap.
The cost of proper housekeeping and maintainance pales into insignificance against the cost of a court appearance and the loss of reputation.
Managers or directors should be sacked for allowing this sort of thing.

we have a flock of birds that just live in our store. at night they come out and swarm on the bakery/home baking departments. they c**p everywhere and many complaints have been made. we are simply expected to wipe c**p off the products before putting them on the shelf if they have been soiled and just sell bakery products despite knowing they were probably being munched on by birds overnight.

apparently pest control will do nothing because of the breed of sparrow.

i myself nearly got into trouble for refusing to put childrens juice boxes on the shelf that were covered in excrement. when told i'd have to wipe them clean and stack them or be in trouble i then whipped out my phone and took a photo of the product in the state it was in and turned to the managers and asked if they still wanted me to put them out. the products were then taken to waste.

it makes me shudder to think they would sell open juice boxes that have been covered in bird c**p and are aimed at children. it could make them very sick, bird excrement can be riddled with disease.

on top of that im sure if something had come out of it and a child died it would of been a case of "so who stacked juice on weds night?"

i remember some years ago a customer returned a part consumed tesco value chicken saying it was off Dm offered  refund of chicken customer not happy wanted £30 as it ruined the whole meal and wanted the other ingredients paid for to (with no proof) not surprisingly the DM obliged so she kept quite not for other customers to here.

I would suggest that the mothers ignorance in covering a chicken pox s**b in the first place is what led to the scarring. A s**b is natures way of protecting the skin underneath . to cover it up she used a plaster which prevented the s**b from drying out completely and falling off revealing the new skin underneath. By covering the s**b with the plaster she created the perfect environment for infection to set in and delay healing.

Looks like it may have been some type of cereal or biscuit type product? If that's the case the thing would be fine to eat months later even if it wasn't at it's prime. If, and if this is the case, I would be very dubious as to whether it caused any discomfort following ingestion.

If it was my child and I was concerned that he or she was developing a rash and vomiting due to consuming something that was worrying to me as a parent, the NHS helpline would have been called. The fact that he didn't call makes me skeptical.

Who in their right mind waits until symptoms subside not knowing when they might, of if ever they will?

Did you even look at the photos in the article, particularly the one with the plaster off?

As for the tetanus shot, more than likely precautionary depending on the childs vaccination history, not indicative of the severity of this "injury".

A voucher from Tesco, and a wee payout from the sun.

Or do you think this is purely coincidental.

Only person I feel sorry for is the child, either the parents are money grabbing, overly protective, or maybe a combination of the two, whichever way god knows what they'll do if he ever falls and scrapes his knee, sue the council for dangerously hard pavements?

I have no issue with people or companies being held responsible for their actions.

But in regards to the pin drama, you're talking about a simple accident that lead to a minor injury.
I don't really know what you expect the outcome to be. It's not like the pin was put there intentially, you can blame routines/training or whatever, but  it was an accident, footwear isn't tagged by putting a pin in the toe of the shoe, it more than likely fell in, either during tagging, or when the shoe was untagged at the checkout.

As for this milk business, it's clearly more serious as anything involving infants usually is.

I'm not sure how something so long out of date could go out, presumably it was sitting out back for months then put out, but either way having the manager give  refresher training on stock rotation wouldn't be the worst idea.

They don't know the meaning of stock rotation in my store, it's all newbies on 10 hour contracts putting the stock on the shelves as most of the long termers scarpered long ago. We once had a complaint on our Dot.com about a multi pack of crisps that were 16 months out of date, no one believed the customer until she returned said crisps to the store. She didn't cause a fuss by the way. she was really understanding about it and it only came to light because she had a box where she kept the crisps and her kids would just take a pack each day and two of them complained that the crisps tasted funny. When the customer checked the packaging she discovered the date, the papers would have had a field day if she had felt the need to inform them. :( :( :(

alf I think you miss the 'point', tags/pins and all the other paraphernalia that is used/misused or just left laying around in stores is for company benefit, with that in mind I fail to see why any person(s) suffering from the misuse/misplacement of equipment should not be handsomely compensated.

I for one would never be fobbed off lightly if injured by equipment which is for the enrichment of the proprietor.

Tesco sold an item it caused an injury, albeit a mild one. The purpose of the offending object in the company makes no difference.

To save time, so we can both get off this merry-go-round, you either think Tesco should issue Training to staff, and/or "handsomely compensate" the person/s.

Personally, I think training would be a waste of time, we have yet to be replaced by robots, we make mistakes, accidents happen, no amount of training will eliminate that.
As for being handsomely compensated for a pin pr**k, I think it's f****ng nuts.

Equalizer87, fair point/question.

Compensation has two purposes, one to compensate the victim for pain/suffering etc the other is to 'encourage' the offender to find ways and means of preventing a recurrence, that will only happen if the cost in £s is punitive.  One answer is perhaps find a tagging system that does not involve pins, or stop tagging.

A great many companies have and know of equipment or procedures that may cause injury, but they balance the cost of compensation against that of rectification.

I say get as much as you can and don't feel guilty about it, you could possibly be making life safer for others.

Nomad, you can debate the merits of compensation all you wish, and frankly no one has disagreed with the general idea of compensation, but it's largely pointless in this context as the parents didn't seek compensation through legal means, instead they went to the sun. that says it all.

Tesco and retailers aren't expected to eliminate all risk of hazards, it's simply not possible.
They are to manage the risk by taking reasonable steps.

If people were constantly  getting injured up and down the country, there would be an issue, but this is a single incident from something like 79 millions shops a week.

It's nothing to do with being hypothetical, it's about not having a risk that is the result of incompetent staff/managers.

Limiting risk is one thing, but creating risk is a totally different ball game.

It's common sense not to put something sharp into a shoe, simple as that.

Well obviously you don't put pins into shoes (do we really need to state this) hence it being an accident.

Sure, these parents could have tried to claim based on that accident, but they didn't.

Are Tesco negligent? Well personally I don't think so, based on the minority of the hazard, and the risk being small.
You may disagree, others can too, or some might agree with me, but unless someone wants to report Tesco to the HSE and let them decide, we may as well p**s into the wind.

If you can't call putting sharp objects or pins into a shoe, where it cannot be seen by any potential wearer negilence, then what is??

At the very least it's a criminal lacking of common sense, but still the injury cannot be justified, hence compensation.

Doesn't really matter if they went through the Sun or solicitors for compensation ( Sun is a smarter option as Tesco hate bad press like the plague). The fact is they would still be owed it for an injury that should never happened.

I don't support the compo culture but it'd nit leaving anytime soon.

The factor of the level of risk, in my opinion, is irrelevant.  The fact that someone had failed to ensure the product was in a fit condition for sale and potential to cause injury and even infections, more than warrants the compensation in anyway it's achieved.

Whether accident,deliberate or negligence compensation is still due.

99% of accidents are caused by human action or inaction, compensation is warranted no matter how small the injury or distress.  As I said earlier in part to encourage a search for a solution/alternative.

Tesco sold an item it caused an injury, albeit a mild one. The purpose of the offending object in the company makes no difference.
The point being not only did it not need to be near a child's shoe, it did not need to be in the store but it was there for the sole benefit of the company.

You two are hell bent on the idea that pin was purposely placed in the toe of the shoe.

Was it negligence?
Again I don't think it was, you do, but its not our decision ultimately.
PS factoring the level of risk is actually essential, the greater the risk and the greater the hazard, the more steps the company needs to reasonably take.

You could receive a paper cut from packaging, but no one is going expect any retailer to somehow eliminate that risk.


As for people's opinion on whether they are entitled to compensation, those opinions  are  worthless, it is for a court to decide, but the parents chose not to go that route, so all we can do is speculate.

No-one gets Lockjaw anymore, not since the second world war and before that when soldiers got trenchfoot with being stuck in waterlogged, rat infested, decaying corpse contaminated trenches.

Just another excuse to cripple the immune system of the young by using them as pin cushions and storing up problems for them later in life.

We've had that, the consequence of having the clothing tagged at source, rather than instore.

Though despite that, I much prefer products being tagged at source, clothing or otherwise. I hate tagging it's so monotonous.

Do I think it was placed there deliberately, of course I do not, I believe it to be an accident.  Was it negligence, possibly but more likely carelessness.  Does any of the afore mentioned negate the right to compensation, no of course it does not.

More than likely due to not maintaining the warehouse doors. One manager we had insisted on the remote light being on so that it opened and closed every time you passed it!! Lasted two weeks, then broke down, never to be repaired!! That was 5years ago! Rentokil are regulars at our store.

As for the big tv programme, that picked up on the amount of bacteria etc..on the trollies. Remember tesco saying they'd all be deep cleaned ??? ???  :-X :-X
