If they issue you with next steps and then fail to review them - if they have an agreed date when they will be reviewed by date captured on the next steps then they have failed to follow procedure and the whole AR can be thrown out.

Next steps form part of the process for supporting your attendance policy. Any part of the policy not followed correctly means that the AR is null and void. That's what our PM always told us. She said if it ever got to an employment tribunal and we hadn't followed procedure it would be thrown out and ruled in favour of the employee.

If they decide to persue the disciplinary appeal on the grounds that they have failed to support your attendance by failing to follow up on the next steps.

As always get advice from a union rep.
