Hi, looking for some advice.  A friend has been off sick for coming up for a year and has got a letter for a final  long term absence meeting, he just want to know what will happen, if he gets paid off due to ill health, thanks.

Don’t see a pay out happening, more likely they’d be dismissed for not been able to furfil there contract.

Paid off probably a  wrong thing to say, I meant what happens to his holidays he has left and shares.

Sorry, that’s incorrect.

If you are dismissed due to ill health, this is contractual dismissal rather than summary dismissal.

Summary dismissal is only really for gross misconduct.

Dismissal for sickness, performance, redundancy should all be contractual dismissal.

The person will receive pay in lieu of notice (can be up to 12 weeks depending on service) as well as any accrued holiday and bank holidays that haven’t been taken.

This will all be paid in their final pay.

m360 is correct.  Also when it is dismissal due to ill health several other factors will determine the issue of partial/full ill health pension being received (or not), and may need looking into.

He will get paid any accrued holiday pay and pay in lieu of notice (amount is dependent on how much service he has).
