Do I have to work bank holidays?

I need clarification as what I'm told differs

I have a flexi contract, I work 16 hrs over a Wed Thur and Sat.  So most BH are Mondays or good Friday, the exception is boxing day and new years day.

If these fall on my working days my question is - do I have to work them or do I have the choice not to?

It's states on your written contract that NO colleague is expected to work Christmas Day, Boxing Day or New Year's Day. Read your contract, highlight the paragraph that states this, then when your manager begins your Christmas working rota, they can ASK you to work Boxing Day and New Year's Day, but you don't have to.

Some of the BS they will try is....

Your flexi so have to do it
It's your contracted day
It's only fair, other colleagues are doing it
You have to do one or the other
You don't have enough BH entitlements so have to work it...should that be the case you can take as unpaid, work time back at a later date or use hol entitlement

Best one....I'm working them!! Yea believe that when I see it...they want you to do it to cover dept so they don't have to  ;)

I'm sure you only have to work them if it's your contracted day.  Otherwise they can ask but not make you.

Check your contract, NOBODY has to work Christmas Day, Boxing Day or New Year's Day, contracted day or not!!

Other bank holidays don't have to be worked unless you have no BH entitlements left to cover. Then again, with the exception of flexi staff, they can be taken unpaid or use holiday entitlement.

With regard flexi, it is something in their contract( unsure of specifics) that they have to work a % of BH days if no cover for dept.

I've got holidays carried over as well as BHs, my contract is Sun, Mon & Tues.  Could I have said no to working tonight and tomorrow?  My manager is the biggest liar I know so I won't ask him.

You could have requested the holiday as usual...with regard to BH entitlement, you should have asked if you wanted to use your remaining BH entitlements for it....though it is very unusual for BH allowances to be carried over, as is unused holiday, so as you are so distrustful of your manager, I would suggest you check with your wages clerk to ensure that you do have hols/BH carried over ???

Festive ones Christmas Day, Boxing Day & New Years day = choice for all.

Other Bank holidays if not flexi = choice.

Other Bank Holidays if flexi & contracted to that day = if they can't get enough to cover by choice they can have you work them.

Other Bank Holidays if flexi & not contracted to that day = they can't make you work it but can ask you to.

This was my understanding when I worked for the company & read about flexi. They tried to make someone work who was not contracted for that day & it failed.

Short answer .... yes, you have to work them.
On your contract there is section "Holidays", all is explained there.

Holidays:

In the event that there are insufficient volunteers to work on bank holidays, colleague joining on or after 26 January 2009, who are scheduled to work on these days, may be required to work on named bank holidays ([you]excluding[/you] Christmas Day, Boxing Day, New Years Day, 2 January (Scotland only) which will remain voluntary for all colleagues).

You don't have to do anything if you are a flexi or retail perm Customer Assistant if the bank holiday falls on your contract days/nights you can always book a holiday or phone in sick.  I wouldn't be doing any favours for a bunch of back stabbing managers and directors who do nothing but remove company perks.

Surely you requested the bank hoildays as days off at your holiday review and not the week before when you find out it is nice weather?....... However it's in your interest to work a the bank hols (obviously not xmas and new years) as you get paid more for it and have a holiday a different day at normal pay.

Hello quick question how does the pay work for bank holidays a manger told me long time ago that it was midday to midday is this correct or is it from midnight to midnight

I work Mondays I'm allowed 2 bank holidays off and paid holiday. Other bank holidays even if the store is closed you still must turn up and work or its a breach of contract.. But you get Sunday pay.

You couldn't have put it better i've heard all this BS too. Some collegues after 10+ year in my place are only discovering that great manager they had was infacting lying to them and playing hard and loose with the facts because they couldn't be arsed spending 2 mins reading the policy and procedure.
